3. TERMS OF SERVICE

 

3.1 Subject Matter

These Terms of Service (“T&S”) govern the contractual relationship between Verde Fish Entertainment SRL (“Seller”) and any person (“Buyer”) placing an order through www.vitalysa.com. Products include: protein supplements (whey isolate, casein, plant-based protein), creatine monohydrate and derivatives, amino acids (BCAA, EAA, glutamine), pre-workout formulas and energy drinks, vitamins, minerals and adaptogens, and sports accessories.

 

3.2 Acceptance of Terms

By placing an order, the Buyer confirms they have read, understood and accepted these T&S in full. These T&S are available in a reproducible and storable format per Art. 8 of Directive 2011/83/EU and Art. 10 of Directive 2000/31/EC.

 

3.3 Minimum Age

Our services are intended exclusively for persons aged 18 or over. By placing an order, the Buyer confirms they are at least 18 years of age. Certain products (e.g., high-caffeine pre-workouts, energy drinks) may be contraindicated for minors. Product label warnings always prevail.

 

3.4 Prices and Availability

All prices displayed are in Romanian Leu (RON) or EUR where indicated, inclusive of VAT unless stated otherwise. Verde Fish Entertainment SRL reserves the right to change prices at any time. The binding price for an order is the one displayed at the time of order completion. Pursuant to the Omnibus Directive (EU) 2019/2161, any displayed discount shows the lowest price in the 30 days prior to the price reduction.

 

3.5 Order Placement and Confirmation

An order is placed when the Buyer clicks “Complete Order” and receives a confirmation email. The sales contract is concluded at the moment of dispatch confirmation. Verde Fish Entertainment SRL reserves the right to cancel orders in the event of pricing errors of a technical nature, indications of fraud or suspicious activity, or product unavailability.

 

3.6 Payment Methods

•       Credit/debit card (Visa, Mastercard, American Express) via 3D Secure gateway

•       Bank transfer (advance payment)

•       Cash on delivery (COD) — available for orders under the courier-set threshold

•       Digital wallets (PayPal, Apple Pay, Google Pay) — where technically available

 

Transactions are processed through a PCI-DSS certified payment system. Verde Fish Entertainment SRL does not store card data.

 

3.7 Warranties and Product Compliance

All products sold are genuine, sourced from authorised distributors or directly from manufacturers. Dietary supplements sold are notified/registered with ANSVSA or the Ministry of Health per Romanian and EU law. Product labels comply with EU Regulation no. 1169/2011, Regulation (EC) 1924/2006, and applicable national measures.

 

For US customers: supplements are marketed under DSHEA (1994) and FDA regulations (21 CFR Part 111). Statements have not been evaluated by the FDA. Products are not intended to diagnose, treat, cure or prevent any disease.

 

For Canada customers: products comply with the Natural Health Products Regulations (NHPR) under the Food and Drugs Act where applicable.

 

For Australia/New Zealand customers: products comply with the Australia New Zealand Food Standards Code and TGA requirements where applicable.

 

WARNING: Dietary supplements are not medicines and do not replace a varied and balanced diet. Consult a physician before use if you have pre-existing conditions, are pregnant, or are breastfeeding.

 

3.8 Legal Guarantee of Conformity

In accordance with Romanian Law no. 449/2003 and EU Directive 2019/771 on the sale of goods, you benefit from a 2-year legal guarantee of conformity for goods purchased. Verde Fish Entertainment SRL is liable for any lack of conformity existing at the time of delivery and manifesting within 2 years thereof.

 

3.9 Intellectual Property

All content on www.vitalysa.com (texts, images, logos, design, source code) is the exclusive property of Verde Fish Entertainment SRL or its licensors, protected under Directive 2001/29/EC and the Berne Convention. Reproduction, distribution or commercial use without the written consent of Verde Fish Entertainment SRL is strictly prohibited.

 

3.10 Digital Services Act (DSA) Compliance

Per Regulation (EU) 2022/2065, Verde Fish Entertainment SRL commits to: transparent terms of service; clear advertising labelling; no use of dark patterns; accessible complaint-handling mechanisms; and cooperation with competent authorities in the removal of illegal content.

 

3.11 Limitation of Liability

Verde Fish Entertainment SRL shall not be liable for indirect, incidental or consequential damages resulting from use of our products; adverse reactions from disregarding label instructions or medical contraindications; or incompatibilities with medications or undisclosed health conditions. Total liability shall not exceed the value of the order placed by the Buyer.

 

3.12 Governing Law and Jurisdiction

These T&S are governed by Romanian law, consistent with EU consumer protection legislation. Disputes will first be addressed amicably; failing that, they will be resolved by the competent courts in Romania. EU consumers may access the European Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr. UK consumers may refer disputes to an approved ADR provider under the Alternative Dispute Resolution for Consumer Disputes Regulations 2015. US consumers may pursue resolution through applicable state consumer protection agencies or card-issuer chargeback procedures.
